This Privacy Policy describes how CyrusOne LLC (“CyrusOne,” “we” or “us”) collects, uses, and shares information about you and applies to your use of cyrusone.com and any online service location that posts a link to this Privacy Policy (hereinafter, the “Service”). This Privacy Policy does not apply to our data collection activities offline or in other contexts (unless otherwise stated below or at the time of collection). This Privacy Policy also describes your choices regarding access to, and use and correction of, personal information that CyrusOne maintains about you.

With respect to personal information that CyrusOne may process on behalf of its customers, CyrusOne shall process such personal information only for the purpose of providing services as directed by the customer.

By using our Service or otherwise providing your personal information to CyrusOne, you are accepting and consenting to the practices described in this Privacy Policy.

What Do We Collect and Where?

Information You Provide to Us

We collect information you provide directly to us via the Service. For example, we collect information when you use or register for our Service, make a purchase, request information from us, participate in contests or surveys, apply for a job, or register for one of our training courses or events through the Service.

The information we collect may include Personal Information. “Personal Information” is information such as your first and last name, phone number, mailing address, e-mail address product and service selections, orders, and other information that can be used to identify you individually (whether alone or in combination). If you apply for employment opportunities, we may collect, for example, information regarding your work experience, educational background, or other details relevant to the job you’re seeking. You may choose to voluntarily submit certain other information to us through the Service, including Personal Information, but you are solely responsible for your own Personal Information in instances where we have not collected such information or requested that you submit such information to us.

We will not intentionally collect or maintain, and do not want you to provide, any information regarding your medical or health condition, race or ethnic origin, political opinions, religious or philosophical beliefs or other sensitive information.

Information We Collect Automatically

We and our Service Providers may automatically collect certain information about you when you access or use our Service (“Usage Information”). Usage Information may include your IP address, device identifier, Ad ID, browser type; operating system characteristics, data regarding network connected hardware (e.g., computer), and information about your use of our Service, such as the time and duration of your visit, the time and duration of the pages on our Service you view, and how you arrived at our Service. We may link this Usage Information to other information we collect about you. To the extent that Usage Information is Personal Information under applicable law, we will treat the combined information as Personal Information under this Privacy Policy.

The methods that we and our Service Providers may use to collect Usage Information include:

  • Log Information: We collect information about your use of our Service, such as IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, and related data, and store it in log files.
  • Information Collected by Cookies and Other Tracking Technologies: We may use cookies, web beacons, embedded scripts, or similar technologies (“Tracking Technologies”) to collect information about interactions with our Service or e-mails, including information about your browsing and purchasing behavior.
  • Cookies: A cookie is a unique alphanumeric identifier that is stored on a user’s device and used to help us identify the number of unique visitors to our website, whether or not the visitor is a repeat visitor and the source of the visits. If a user rejects the cookie they may still use our site; however, the user may be limited to the access of some areas within our website.
  • Web Beacons (“Tracking Pixels”):Web beacons are small graphic images, also known as “Internet tags” or “clear gifs,” embedded in web pages and e-mail messages. Web beacons may be used to count the number of visitors to our Service, to monitor how users navigate the Service, and to count how many particular articles or links were actually viewed.
  • Embedded Scripts: An embedded script is programming code designed to collect information about your interactions with the Service. It is temporarily downloaded onto your computer from our web server or a third party with whom we work, is active only while you are connected to the Service, and deleted or deactivated thereafter.

We are giving you notice of the Tracking Technologies and your choices regarding them explained below in the “Choices: Tracking and Communications Options” section below, so that your consent to encountering them is meaningfully informed.

Information from Other Sources

We may also obtain information about you from other sources and combine that with information we collect about you. For example, we may receive reports based on the use of Tracking Technologies from third parties on an individual and aggregated basis. To the extent we combine such third party sourced information with Personal Information we collect directly from you on the Service, we will treat the combined information as Personal Information under this Privacy Policy. We are not responsible for the accuracy of the information provided by third parties or third party practices.

What Do We Use This Information For?

We may use information about you for any purposes not inconsistent with our statements under this Privacy Policy or prohibited by applicable law, including to:

  • Facilitate, manage, personalize and improve your online experience;
  • Transact with you, respond to your comments, questions and requests, provide customer service, send you informational notices, and contact you if we need to obtain or provide additional information;
  • Conduct research and analysis, including focus groups and surveys;
  • Process job applications received through the Careers page;
  • Prevent and address fraud, breach of policies or terms and threats or harm; and
  • Send you advertisements and communicate with you regarding our and third party products, services, offers, promotions, rewards and events we think you may be interested in (for information about how to manage these communications, see “Choices: Tracking and Communications Options”).

How and To Whom Do We Disclose This Information?

Your information, including Personal Information and Usage Information, may be disclosed to our agents, vendors, consultants, marketing service providers, and other service providers (collectively “Service Providers”) who perform functions on our behalf. These Service Providers are prohibited from using your Personal Information for any purpose other than to provide this assistance, although we may permit them to use aggregate information for other purposes. We may also share information about you with our Service Providers as follows:

  • To comply with the law, law enforcement or other legal process, and except as prohibited by applicable law, in response to a government request;
  • To protect the rights, property, life, health, security and safety of us, the Service or any third party;
  • With our affiliates for internal business purposes;
  • E-mail addresses which have requested no further contact will be placed on a suppression list that may be accessed by other organizations to maintain suppression of such addresses in their mailings as well as ours; and in connection with, or during negotiations of, any proposed or actual merger, purchase, sale or any other type of acquisition or business combination of all or any portion of our assets, or transfer of all or a portion of our business to another company.
    Without limiting the foregoing, in our sole discretion, we may share aggregated information which does not directly identify you with third parties or affiliates for any purpose. We do not sell your Personal Information to third parties.

Testimonials

We display personal testimonials of satisfied customers on our website in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at privacy@CyrusOne.com.

Sweepstakes, Contests, and Promotions

We may offer sweepstakes, contests, and other promotions (each, a “Promotion”) jointly sponsored or offered by third parties that may require submitting Personal Information. If you voluntarily choose to enter a Promotion, your Personal Information (e.g., name, email address, mailing address) may be disclosed to third parties for administrative purposes and as required by law (e.g., on a winners list). By entering, you are agreeing to the official rules that govern that Promotion, and may, except where prohibited by applicable law, allow the sponsor and/or other parties to use your name, voice and/or likeness in advertising or marketing materials.

Third-Party Services

We may provide links to third-party websites for your convenience and information to websites, locations, platforms, or services operated by third parties (“Third Party Service(s)”). These Third Party Services may use their own cookies, web beacons and other Tracking Technology to independently collect information about you and may solicit Personal Information from you.

The privacy practices of these Third Party Services may differ from our privacy practices and are not controlled by us, nor are they covered by this Privacy Policy. We do not make any representations regarding the policies or business practices of any third parties or Third Party Services and we encourage you to review their privacy policies before submitting any Personal Information.

Social Features

Our Service may permit interactions that you initiate between the Service and certain Third Party Services, such as third party social networks (“Social Media Features”). Examples of Social Media Features include the Facebook button and Widgets, such as the Share this button or interactive mini-programs that run on our Service. These Social Media Features may collect your IP address, which page you are visiting on our Service, and may set a cookie to enable the Social Media Features to function properly, among other things. Social Media Features may be either hosted by a third party or hosted directly on our Service. Your interactions with these Social Media Features are governed by the privacy policy of the company providing the feature. To the extent we combine information from Third Party Services with Personal Information we collect directly from you on the Service, we will treat the combined information as Personal Information under this Privacy Policy.

Advertising, Analytics Services, and Online Tracking

We may engage and work with third parties to serve advertisements on our behalf on the Service and/or on Third Party Services and to provide analytics services about the use of our Service and the performance of our ads and content on Third Party Services. In addition, we may participate in online advertising networks and exchanges that display relevant advertisements to our Service visitors, on our Service and on Third Party Services and off of our Service, based on their interests as reflected in their browsing of the Service and certain Third Party Services. These entities may use cookies and other Tracking Technologies to automatically collect information about you and your activities, such as registering a unique identifier for your device and tying that to your online activities on and off of our Service. We may use this information to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on the Service and Third Party Services and better understand your online activity.

In addition, we may serve ads on third party services that are targeted to reach people on those services that are also identified on one of more of our data bases (“Matched List Ads”). This is done by matching common factors between our data bases and the data bases of third party operators. For instance, we may use such ad services offered by Facebook or Twitter. If we use Facebook to serve Matched List Ads on Facebook services, you should be able to hover over the box in the right corner of such a Facebook ad and find out how to opt-out with us from such list. If you opt-out from our Facebook Matched List Ads, we will remove the matching Personal Information from that list, however, this will not take effect immediately and if you have multiple e-mails or other accounts you may have to opt-out separately for each one. If we use Twitter Matched List Ads, you should be able to opt-out through your account settings on Twitter. If you opt-out from our Twitter Matched Use Ads, you will be removed from that list, however, this will not take effect immediately and if you have multiple e-mails or other accounts you may have to opt-out separately for each one. We are not responsible for such Third Party Services’ failure to comply with your or our opt-out instructions or to provide us notice of your opt-out elections, and they may change their options without notice to us or you.

Some information about your browsing of the Service and certain Third Party Services may be collected across time and services and shared with third parties to deliver ads and/or other content to you on the Service and certain Third Party Services. We may receive information about Third Party Services that you have visited and use it for marketing purposes—a practice sometimes termed “(re)-targeting,” “interest-based advertising,” and “online behavioral advertising.”

We are not responsible for third parties or Third Party Services associated with advertising and analytics services, and related tracking activities. Consult their privacy policies and notices for information on their practices and see “Choices: Tracking and Communications Options” below regarding certain choices some of them may offer you.

Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note there is no consensus among industry participants as to what “Do Not Track” means in this context. Like many online services, we currently do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser. Children’s Privacy

The Service is not directed to children, and we do not knowingly collect personal information from children under the age of 13. If we learn that we have received personal information from a user under the age of 13, we will delete the information.

Data Security

CyrusOne is committed to industry best practice approaches concerning security. We take reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. We use various security measures to protect the information we collect including firewalls and access controls. We store information you provide to us on a computer system located in a controlled facility with limited access. Visitor information is accessible only by CyrusOne employees, contractors and agents on a need-to-know basis and who have entered into and are bound by a confidentiality and non-disclosure agreement with CyrusOne. Nevertheless, transmission via the Internet is not completely secure and we cannot guarantee the security of your information collected through our Service.

International Transfer

We are based in the U.S. and the information we collect under this Privacy Policy is governed by U.S. law. If you are accessing the Service from outside of the U.S., please be aware that information collected through the Service may be transferred to, processed, stored and used in the U.S. Data protection laws in the U.S. may be different from those of your country of residence. Your use of the Service or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing and storage of your information, including Personal Information, in the U.S. as set forth in this Privacy Policy. Data Rights and Retention

Right to Access Your Personal Information

Upon request, CyrusOne will provide data subjects with information about whether we hold their personal information. If you believe that personal information we have about you is incorrect or has been used inappropriately, please contact us at privacy@CyrusOne.com and we will take steps to correct or delete the information, or restrict its use, as appropriate. We will respond to requests of this nature within a reasonable timeframe.

CyrusOne acknowledges that data subjects have the right to access personal information maintained by data controllers. Please note that CyrusOne has no direct relationship with the individuals whose personal information may be processed by its customers. An individual who seeks access to, or who seeks to correct, amend, or delete personal information processed by, a CyrusOne customer should direct such queries to the relevant CyrusOne customer (the data controller). If requested to remove personal information that CyrusOne controls, we will respond within a reasonable timeframe.

Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to change any information regarding your account or request that we no longer use your information to provide you services contact us at privacy@CyrusOne.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We retain personal information we process on behalf of our customers for as long as needed to provide services to our customers or to otherwise fulfill the purpose(s) for which the personal information was originally collected. In addition, CyrusOne retains personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Data Integrity

Personal information we collect is relevant for the purposes for which it is to be used. CyrusOne takes reasonable steps to help ensure that data is reliable for its intended use, accurate, complete and current.

Verification

CyrusOne utilizes the self-assessment approach to ensure its compliance with its Privacy Policy. CyrusOne regularly verifies that the Privacy Policy is accurate, comprehensive, prominently displayed, and completely implemented and conducts its self-assessment on an annual basis to ensure that all relevant privacy practices are being followed. Appropriate employee training is in place and internal procedures for periodically conducting objective reviews of compliance are in place. A statement verifying this self-assessment is signed by a corporate officer or other authorized representative at least once a year.

Choices: Tracking and Communications Options

Tracking Technologies Generally

Regular cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options so you may need to set them separately. Please be aware that if you disable or remove cookies some parts of our Service may not work and that when you revisit our Service your ability to limit browser-based Tracking Technologies is subject to your browser settings and limitations.

Analytics and Interest-Based Advertising

Certain companies may participate in the Digital Advertising Alliance (DAA) AdChoices Program and may display an Advertising Option Icon for interest-based ads that links to an opt-out tool which allows you to exercise certain choices regarding targeting. In addition, certain advertising networks and exchanges may participate in the Network Advertising Initiative (NAI). NAI has developed a tool that allows consumers to opt-out of certain targeted advertising delivered by NAI members’ ad networks. Please be aware that, even if you are able to opt-out of certain kinds of targeted advertising, you will continue to receive non-targeted ads. We are not responsible for effectiveness of, or compliance with, any third parties’ opt-out options or programs or the accuracy of their statements regarding their programs. However, we support the ad industry’s 2009 Self-Regulatory Principles for Online Behavioral Advertising and expect that ad networks we directly engage to serve you interest-based ads will do so as well, though we cannot guaranty their compliance.

Communications

You can opt-out of receiving promotional e-mails from us at any time by following the instructions as provided in e-mails to click on the unsubscribe link or sending an e-mail to unsubscribe@CyrusOne.com with the following subject line: “Please remove me from all e-mail lists”. Please note that your opt-out is limited to the e-mail address used and will not affect subsequent subscriptions. If you opt-out of only certain communications, other subscriptions may continue. Even if you opt-out of receiving promotional communications, we may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or our ongoing business relations.

As with e-mails, even if you opt-out of receiving promotional communications, we may continue to send you non-promotional push notifications, such as those about your use of the applications or our ongoing business relations.
